Supplement Notices to Residents of Washington

This portion of our Policy only applies to Washington state residents.

As a Washington resident, the Washington State My Health My Data (“MHMD”) Act gives you certain choices regarding your health data, as described below. The law applies only to “consumer health data” about your past, present, or future health condition.

Consumer Health Data We May Collect: We collect data from a variety of sources. Because consumer health data is defined very broadly in the MHMD, much of the data we collect could also be considered consumer health data.

Examples of consumer health data we collect may include:

Information about your child’s health-related conditions, symptoms, status, or treatments. For example, your use of our products may give us insight into your (or your child’s) health status. We also collect health information when you interact with our website through quizzes and similar offerings. These surveys and calculators give us additional insight into your health status.

Information that could identify your propensity to seek health care services or information.

Behavioral biometrics resulting from your use of our websites. Data collected may include pages visited, actions taken (button clicks, products purchased, files downloaded, samples ordered, searches performed, and other actions taken), and keystrokes.

Inferences derived from the above data.

Sources of Consumer Health Data

We collect personal data (which may include consumer health data) from three main sources:

  • Information you provide us directly by ordering products, signing up for newsletters, filling out surveys, entering promotions, or registering for an account.
  • Information collected automatically with you browse our website.

Why We Collect and Use Consumer Health Data

We collect and use this data as reasonably necessary to provide you with the products you have requested and to market to your interests. Providing requested products to you may include delivering the products, making suggestions about what products are appropriate for you, and/or personalization of certain product features. We also use consumer health data to improve our products and for other essential business operations, such as analyzing our performance, meeting legal obligations, and conducting research and development.

We may also use consumer health data to market or advertise our own products and services. We may also use your purchase history or information received from third parties to advertise other products we sell that we think may be of interest to you.

For marketing and advertising, we give you choices and/or obtain your consent as required by law. Please see the opt out section.

Disclosures of Consumer Health Data

We may share each of the categories of consumer health data described above with your consent or as reasonably necessary to provide our products and services.

We may also share your information with service providers who operate on our behalf to help us provide you with products and services you have requested, to make product improvements, and to market and advertise our products and services to you.

Processors and other Third Parties with whom We Share Consumer Health Data

As necessary for the purposes described above, we may share consumer health data with the following categories of third parties: Service Providers, Third Parties and Partners, and Government Agencies and Law Enforcement. Examples include: analytics companies, advertisers, and social media networks as well as parties to a business transaction such as a corporate merger.

How to Exercise Your Rights

The MHMD Act provides certain rights with respect to consumer health data. These rights include your right to access your consumer health data and receive a list of all third parties and affiliates—including contact information—who receive your health data. You also have the right to request that we delete your consumer health data. You can withdraw consent relating to the collection and sharing of your data too, subject to certain exceptions.

You can request to exercise such rights by filling out this formOpens in a new tab.

If your request to exercise a right under the MHMD Act is denied, you may appeal that decision by contacting our Global Privacy Officer at [email protected]Opens in a new tab. . If your appeal is unsuccessful, you can raise a concern or lodge a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaintOpens in a new tab..

This Cookie Policy explains how we use cookies and similar technologies in connection with our website and any other website that we own or control and which posts or links to this Cookie Policy (collectively, the “Sites”).

What are cookies?

Cookies are small data files sent from a server to your web browser. They are stored in your browser’s cache and allow a website or a third party to recognize your browser.

Our sites may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer or mobile device until you delete them). We specifically use two types of cookies:

(1) first party cookies, provided directly by us to your computer or mobile device, which we use to recognize you when you revisit our Sites; and

(2) third party cookies, which are served by service providers or other third parties, and can be used by these parties to recognize your computer or mobile device when it visits other websites. Third party cookies can be used for a variety of purposes, including site analytics, advertising, and social media features.

We Use the Following Categories of Cookies.

Essential cookies: These cookies are strictly necessary to provide you with services available through our Sites and to use some of its features. Refusal of these cookies may impact Site functionality.

Performance and functionality cookies. These cookies are used to enhance the performance and functionality of our Sites but are not required for site use. However, without these cookies, you may lose functionality, and we will not be able to conduct analytics to optimize site functionality and performance.

Analytics and customization cookies: These cookies collect information that is used either in aggregate form to help us understand how our Sites are being used generally, or how effective our marketing campaigns are, or to help us customize our Sites specifically for you. Without these cookies, we will not be able to analyze your site usage to provide custom content.

Advertising cookies: These cookies are used to make advertising messages more relevant to you. They perform functions like preventing the same ad from continuously re-appearing, ensuring that ads are properly displayed for advertisers, and in some cases selecting advertisements that are based on your interests.

Other technologies

In addition to cookies, our Sites may use other technologies such as pixel tags to collect information automatically.

UTM codes: These are strings that can appear in a URL (the “Uniform Resource Locator,” which is typically the http or https address entered to go to a web page) when a user moves from one web page or website to another, where the string can represent information about browsing, such as which advertisement, page, or publisher sent the user to the receiving website.

Local Storage Objects: These are sets of data that can be stored on your browser by a site or app. They can be used to maintain preferences, a history of usage, or even the state or settings of a site or an app.

Internet of Things identifiers: Like mobile identifiers, internet-connected devices such as voice activated assistants or smart TVs may send identifiers and other data analogous to web browsers.

Web beacons: These are tiny graphics (sometimes called “clear GIFs” or “web pixels”) with a unique identifier that are used to understand browsing activity. In contrast to cookies, which are stored on a user's computer hard drive, web beacons are rendered invisibly on web pages when you open a page.

Your choices

There are a number of ways that you can opt-out or manage cookies. Your options for controlling what information cookies and similar technologies collect about you include:

Your Cookie Settings. When you visit our Sites, depending on where you are located, we may show you a notice which tells you how and why we use certain cookies and provide you the ability to opt out of certain cookie use (other than Essential cookies necessary to provide our Sites).

Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.

Using privacy plug-ins or browsers. You can block our websites from setting cookies used for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party cookies/trackers. You can also opt out of Google Analytics by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptoutOpens in a new tab..

Blocking advertising ID use in your mobile settings. Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes. Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit.

If you do not accept our cookies, you may experience some inconvenience in your use of our Sites. For example, we may not be able to recognize your computer or mobile device and you may need to log in every time you visit our Sites.

For more information about how we collect, use and share your information, see our Privacy Policy.

Changes

Information about the cookies we use may be updated from time to time, so please check back on a regular basis for any changes.
